Following a quarrel early last evening, Charles C. Smith, a farmer, who lived four miles northwest of Muncie on the Bethel Pike, was beaten to death by his 22 year old son, Benjamin Harrison Smith, who carried the mutilated corpse of his aged father in a buggy to a dug well on the Petty farm a mile northwest of the Smith home, where he dumped it into the hole. Immediately thereafter the murderer went to the house of a neighbor and told a story of attack by burglars. "Seated" by the police young Smith confessed in detail one of the most brutal and unnatural crimes ever committed in Indiana. The murder was committed on the eve of the victims 69th birthday anniversary, it's occasion was the farther's reproof of a worthless son and the suggestion that he should bear a part of the expense of the maintaining the household.

Last evening at about 8:30 o'clock a call was recieved at the police station from Oscar Shaw, who lives about a half mile east of the Smith house, stating that Benjamin Smith had stumbled into his house and after announcing that he had been attacked by burglars and badly injured, fainted. Members of the police department went to the Shaw home and later in the evening Sheriff O'Harra and Patrolman Marshall visited the Smith home where they found the young man in bed.

When young Smith was asked about the cause of his injuries he stated that he had been in Muncie and was returning home at about 7 o'clock last evening. He was walking along the road, he said, about a mile from his home when he heard a rig approaching and looking around though he recognized it as the horse which was driven by his father Smith stated that he waited for the rig to come along side, and when it did so two masked men jumped out and attacked him. Afterwards they placed him in the buggy and he was able, he said to drive to the Shaw home and spread the alarm. Leaving the impression that his father had been killed by the two highwaymen the farmers in the neighborhood joined the police and the sheriff and a complete search was made for the missing man but it was of no avail.

- BROUGHT TO POLICE STATION -
The police soon saw several hitches in the story as told by young Smith and at an early hour this morning he was arrested by Patrolman Prutsman, Lovett and Marshall and brought to the station. It was only after several hours of rigid examination that he was at last forced to confess that he was responsible for the crime and that his father's body could be found in the dug well at the old Petty farm on which there is no tenant.

The murderer accompanied by several officers and the officials who are conducting the examination drove back to the scene of the murder this morning at about 9 o'clock. The crime developed to be even more brutal and savage than had at first been expected, and after the finding of the body and the return to this city young Smith made a complete breast of the affair.

- HIS CONFESSION -
Before Prosecutor Long and assistants Smith told the horrible story. He said that he and his father had been having trouble during the day and in a hot argument the old man stated that if the boy did not pay $2.00 a week for his board and room that he would make him leave home or turn the bill over to the sheriff for collection.

After having held firm all morning in his statement that his father had thrown a brick and struck him, and he in turn had used it as a weapon of murder, Benjamin Harrison Smith confessed that a monkey wrench had been used instead. The confession came shortly after noon following a report which had been made by the cororner saying a brick could never have inflicted the wounds on the murdered's man's head. In his final confession the young man stated the father threw the brick, it striking him on the shoulder. He in turn threw it back at his father and then picked up the monkey wrench and struck the elder Mr. Smith a number of times on the head. After having thrown the body in the well on his return drive Smith threw the wrench along the roadside after he had turned west on Wheeling pike on the road to Bethel. He in company with Detectives Coons and Guffigan left Muncie, late this afternoon in an automobile, young Smith promising to show the officers the place where he discarded the deadly weapon.

Smith took the detectives to a spot on the Wheeling pike, two miles distant from the place where the murder was committed and there produced the monkey wrench with which he had beaten his father. The wrench was covered with blood and matted hair. He also showed them the brick which he had used with such deadly effect. Smith seems inclined now that

he has stated to tell the truth about the awful affair, to give up every detail of the story and make a clean breast of the whole matter.

- SON ALONE RESPONSIBLE -
The police department believes the son is alone responsible for the murder and the wife and daughter were unaware of the horrible deed until the facts were uncovered today. Mrs. Smith and her daughter Miss Margaret who were held in custody all morning were allowed to return home this afternoon. They were both at the point of a nervous break - down when they left the station.
Before making his confession this morning young Smith was very nervous and agitated but this afternoon he was holding up much better and does not seem to be in the least worried over the serious charge which he must face. He expressed no sorry or regret for his actions and the police say he is one of the most hardened criminals with whom they have ever dealt.
One of his requests was that he be allowed to see the papers and read what they had to say in regard to the crime.
The murder of the father by his son and the manner in which it was committed marks it as the most brutal act which has ever occurred in Delaware county. The members of the police department assisted by sheriff O'Harra and his deputies have been working to secure all the evidence in the case and are leaving no stone unturned to fully unravel the case.
The son decided to settle the matter that very day and in the early evening when the father drove to town to bring home his twenty-three year old daughter who is employed at the Ontario Silver works young Smith remained in the barnyard waiting for him. The daughter Margaret Smith who with the mother, father and brother, live at home got out of the buggy at the gate and went into the house. The murdered man walked into the barnyard which he had entered so often during the past fifteen years little realizing the fate which awaited him. Benjamin Smith was waiting for the father and started to help unhitch the horse. When the father asked him what he was doing the son remarked that it was none of his d___ business. With that the old man picked a brick from the bottom of the buggy which was wrapped in newspaper and was used during the cold weather as a foot warmer and the son alleges that he hurled it at him.

- THE SON'S MODE OF REVENGE -
Then the boy, degenerate as he must be, committed the horrible deed. He told the story to the officers in a cold-hearted sort of a way. Picking up the brick, which he claims the father had thrown at him the young man walked around the buggy and struck his father in the head with the missile. It is thought that the skull must have been crushed by the first lick and the boy said that the father tumbled to the ground. When asked what he did afterwards Benjamin stated that every time the father groaned he struck him again until the skull was almost completely caved in.
Just how he could best dispose of the body was the next question which came before young Smith and loading the lifeless form into the rig from which the horse had not been unhitched he drove to the old Perry farm and dumped the body head foremost into the well. Then he drove back by the Shaw home and told the story which was at first reported to the police department and which later led to his confession.
The well which was used as a place to conceal the body was but about fifteen feet deep and only had a few feet of water in it. The result was then when the searchers located the lifeless form this morning both feet were sticking above the surface of the water. The ground in the neighborhood of the well was covered with the blood of the murdered man and the water in the well was stained a faint red. Those who pulled the body from the well say they will always be haunted by the memory of the scene. The head and face had been crushed at least a dozen times. The murdered man wore long whiskers and these were stained by the bloody water. The expression on the face was that of struggle and the strained and cramped arms and hands were covered with mud.
After the body had been pulled from the well it was allowed to remain on the ground until coroner cecil arrived who after a brief inspection ordered the remains to be taken to the Groman-Farmer morgue where the official investigation is going on today. The members of the family and the neighbors will be examined before the coroner makes his official report, but there is not the least doubt but what Benjamin Smith will be charged with murder in the first degree.

- MYSTERIOUS FIRE -
After returning to his home following the disposing of the body it is thought that Smith built a fire and tried to cover up all evidences of the struggle, which had occurred in the barnyard. However, this morning blood could be plainly seen on the ground surrounding the little barn. There was also blood on the horse's hind legs as there was on the buggy, which was used to convey the body to the well. The question which is now puzzling the police is at just what time the fire was kindled. If it was before the crime it would surely have been known to Mrs. Smith who was at home at the time, the house standing about 125 feet northwest of the barn. With the home in a whirl of excitement it woud not be logical to think the fire could have been kindled afterwards without exciting suspicion.

- HIS FIGHT FOR LIFE -
When brought into police headquarters at an early hour this morning young Smith had a bandage around his head but there is no mark, which would lead one to believe that he was in the least seriously injured in the battle with the father who must have made a desperate fight for his life. The son's hands were cut and bruised but the fight between the father and son could not have lasted long. The murdered man was what might considered as small in statue, bent and weakened by age while the son is a strapping good sized boy and his assaults could not have been checked even by the fierce determination of a man faced by a fight for life, yet who was robbed of the energy of youth.

- THE DAUGHTER'S STORY -
The wife of the murdered man and the daughter, Miss Margaret, who lived at home, were brought to Muncie today and are being held at police headquarters. While each shown signs of the heavy strain upon them they are holding up wonderfully well under the ordeal. The daughter in a statement to other members of the family said that her father arrived at the factory at the usual time last evening and that they were accompanied on the drive homward by Lena Holmes, who lives near Andersonville. The Holmes girl got out at her usual stopping place and Miss Smith says she left her father at the barnyard gate and went into the house to help her mother prepare the supper. This was about 7: 15 in the evening. She stated after being in the house for about a half hour and upon the father failing to come in she went into the barnyard and both Mr. Smith and the horse and buggy were missing. She became alarmed and ran to the home of ?ate Anderson a neighbor and asked that the people in the community help find the missing man. It was at about this time that the son made his appearance and told the story in regard to the highwaymen.

- FATHER OF FOURTEEN CHILDREN -
The Smith family came to Indiana from Kentucky about fifteen years ago and during this time have resided on a three-acre tract of ground where the murder was committed. Several of the children who live in this neighborhood were at the home this morning after the mother, daughter and son had been taken to the police station. In speaking of the murder they did not seem the least excited and talked over the trouble in a matter-of-fact way, as though it were an every day occurrence. They said they knew of no trouble between the father and son with the exception of that over the boy paying for his board and room. One brother stated that while Benjamin never drank, he had always been a shiftless lazy lad and never willing to help his father provide for the wants in the home.

Mary (Timberlake) Smith shows up with husband Charles Smith starting in the 1870 Greenup Kentucky Census in Precinct 2 Greenupsburg she is listed as 24 years old born in W.V. and the mother of 4 children Ida May age 10, Sarah S. age 5, Virginia E. age 3 and Charles T. age 1.

Then Mary also shows up in the 1880 census with Charles Smith in the Globe School House Greenup Kentucky Mary is listed as 35 years old born in 1845 and in W.V. and the mother of 8 children Sarah L. age 16 born 1864 in Ky, Viriginia E. age 13 born 1867 in Ky, Chas. T. age 11 born 1869 in Ky, Lavina (my 2nd great grandma) age 9 born 1871 in Ky, Luella age 5 born 1875 in Ky, Letitia age 3 born 1877 in Ky, Martha age 1 born 1879 in Ky, Wm. The 1900 Census she indicated she was born in the year 1866 instead of 1864. I'm not sure I have the correct family here - I very well could be wrong.


Research Notes: Child - Lavina Smith

From Donata Boyle:
She up and left the family sometime between 1907-1911 I think. She was married 3 more times (married 4 times total) her 2nd marriage was to Charles Acton her 3rd marriage was to Ed Thronbro her 4th and final marriage was to Harry Sheets to whom she was married to when she died April 14, 1929 in Richmond State Hospital in Richmond Wayne County Indiana. Died at age 58 years and 27 days old.

She was brought back to Muncie Delaware County Indiana and was buried next to her youngest daughter Genevia and her 1st husband George Oliver Howe in Beech Grove Cmty. (no stones on either of the three graves).
